Position Statement
Local Planning Authority policies are automatically saved for a period of three years following the commencement of the Planning and Compulsory Purchase Act 2004. This meant Rossendale's Local Plan policies were automatically saved for three years until 27th September 2007. During this three year period, Local Authorities should bring forward new Local Development Documents as part of the new Local Development Framework. Policies can be saved beyond this three year period, however the Local Planning Authority must demonstrate to the Secretary of State that the policies it intends to save reflect the principles of Local Development Frameworks; are consistent with current national policy; and that it is not feasible or desirable to replace them by 27th September 2007. Due to delays in production of the LDF the Council has now brought forward the policies it wishes to save beyond this period.
The Secretary of State is satisfied with the Council's justification for saving these policies and has issued a direction to save them.
